Truck Wreck Causes TBI

Practice Area: Trucking Accident Date: 2017 Case Information: A TBI inflicted loss of smell and taste on our client and resulted in a record recovery for a non-personal-injury case in Yakima, WA. The case was complicated by the first at-fault vehicle, a pickup truck, not having insurance and by the trucking company blaming our client as well as the pickup driver. Tanker Truck v. Bicycle

Practice Area: Trucking Accident Date: 2015 Case Information: Morgan Adams was a consultant on trucking and liability issues in a case tried by Steve Gursten, a great trial lawyer in Michigan. The defendant was a truck driver who struck and killed an 83-year-old cyclist in a crosswalk while making a right turn on red. The defendants refused to accept any responsibility, but a jury disagreed and found them liable for the victim’s wrongful death. The case went on appeal to the Michigan Supreme Court, which found in favor of the plaintiff’s liability position. Outcome: $2.5 million verdict

Practice Area: Trucking Accident Date: 2016 Case Information: Mild traumatic brain injury resulted in a $1.5M settlement in Knoxville, TN. Our client was injured when a tractor-trailer hit her vehicle in the rear. We were able to show that the truck driver lied about a medical condition in order to acquire a commercial driver’s license. Outcome: $1.5 million settlement

Practice area: Trucking Accident Date: Nov. 30, 2010 Outcome: Highest settlement for a mild traumatic brain injury in Smith County, Tennessee.

Tractor-Trailer v. Tractor-Trailer and Shipping Company

Practice Area: Trucking Accident Date: 2016 Case Information: Amputation resulted in a settlement in Jackson, TN. The shipper, who should have known better, hired an unsafe trucking company to haul its loads in order to save money. Recovery was limited due to Tennessee’s law (Tort Reform) that limits the amount of non-economic damages recoverable in cases as well as the insurance policy limits of the most-at-fault party. Outcome: $1.5 million settlement

ractice Area: Trucking Accident Date: 2016 Case Information: Wrongful death and mild traumatic brain injury resulted in a settlement in Houston, Texas. Results were limited by the insurance policy limits of the most-at-fault party. Outcome: $2.1 million settlement

Tractor-Trailer v. Minivan

Practice Area: Trucking Accident Date: 2015 Case Information: Injuries caused hospitalization and the eventual death of an 80-year-old Delaware man. The victim’s family settled without filing suit. Outcome: $3 million settlement

Car v. Tractor-Trailer

Practice Area: Trucking Accident Date: 2015 Case Information: An uninsured car driver pulled directly in front of a tractor-trailer near Newport, TN. Our client, a passenger in the car, suffered severe brain injuries. We were able to prove that the truck driver and trucking company had some fault for traveling too fast on rain-slicked roads. Outcome: $800,000 recovery

Drunk Driver v. Student

Practice Area: Trucking Accident Date: Jun. 19, 2012 Case Information: Our client, an 18-year-old honor roll student and cheerleader at a high school in Tennessee, was injured when an intoxicated driver with two prior DUIs collided with her vehicle head-on. After a trial, the jury in this case found the defendant negligent and reckless in causing the collision, and they returned a unanimous verdict against the defendant for $350,000 in past damages, $150,000 in future damages, and $8.75 million in punitive damages — the largest punitive damage award for drunk driving in Tennessee history. Outcome: $9.25 million verdict
